COUNTY BOARD OF LEGISLATORS
OCTOBER 10, 2006 (7:00 P.M.)
The County Board of Legislators met pursuant to adjournment.
The Honorable William J. Ryan in the Chair.
The Chair opened the meeting with the salute to our flag and an invocation.
The roll call resulted as follows:

Motion – Approval of Minutes. Mr. Rogowsky moved that the minutes of September 25, 2006 (Regular Meeting) be approved – Carried.
Mr. Rogowsky moved to suspend the regular order of business for the purpose of holding three public hearings. – Carried.
The Clerk presented proof of publication of notice of the Public Hearings and read the rules for its conduct.
PUBLIC HEARING: COMMITTEE ON BUDGET &
APPROPRIATIONS AND THE COMMITTEE ON
PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS:
Sewer District Modification: ACT 200-2006: Proposed Act
modifying the Upper Bronx Valley Sanitary Sewer District by the
removal of fifty-nine (59) parcels located in the Town of North
Castle.

PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: Sewer District Modification: ACT 201 -2006: Proposed Act modifying the Mamaroneck Valley Sanitary Sewer District by the addition of fifty-seven (57) parcels located in the Town of North Castle.
There were three speakers.
No other person wishing to be heard, Mr. Rogowsky moved to close the Public Hearing and resume the regular order of business.
PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: Quarry Heights Sewer District Map: LOCAL LAW INTRO 15-2006: Local Law amending Section 964.22 of the Laws of Westchester County in order to strike the map contained therein and replace the stricken map with a map which reflects the revised sewer district designations of the Quarry Heights parcels.

UNFINISHED BUSINESS: COMMITTEE ON APPOINTMENTS: Rent Guidelines Board: RES 184 -2006: Resolution recommending appointment by the New York State Division of Housing and community Renewal, of Mr. Sterling Jasper as a Public Member of the Westchester County Rent Guidelines Board.
On motion of Mr. Rogowsky, the following item was recommitted.
COMMUNICATION: COUNTY EXECUTIVE: Sewer District Modification: Proposed Act to modify the Blind Brook Sanitary Sewer District by the removal of 1 property (3 parcels) located in the Village of Rye Brook was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.
COMMUNICATION: COUNTY EXECUTIVE: Resource Allocation Plan: Proposed Act authorizing the County to execute and submit to the State of New York a Resource Allocation Plan which will provide State reimbursement for certain youth services programs was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Generational, Cultural and Ethnic Diversity.
COMMUNICATION: COUNTY EXECUTIVE: IMAs – GIS Data: Proposed Act authorizing the County to enter into IMAs with Westchester County municipalities, and with the counties of Putnam, Rockland and Dutchess, and the municipalities located within such counties, for the purpose of sharing geographic information system (“GIS”) data was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Housing, Planning and Government Operations.

COMMUNICATION: COUNTY EXECUTIVE: Property Sale: Proposed Act authorizing the sale of County-owned residual parcel NROT in the City of New Rochelle located adjacent to Flandreau Avenue was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.
COMMUNICATION: COUNTY EXECUTIVE: Court Ordered Refunds: Forwarding a package of court ordered refunds to be paid by the Commissioner of Finance was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.
COMMUNICATION: COUNTY EXECUTIVE: Capital Budget Amendment & Bond Act: Proposed Capital Budget Amendment and related Bond Act to finance Capital Project RP049 – Stored Value Card Ticketing System Access Control Enhancements, Various County Facilities was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.
COMMUNICATION: COUNTY EXECUTIVE: IMAs – Prisoner Transportation: Proposed Act authorizing the County to enter into IMAs with thirty (30) municipalities in order to provide reimbursement for prisoner transportation to the Westchester County Jail was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety and Security.
COMMUNICATION: HON. THOMAS ABINANTI: Mortgage Recording Taxes: Forwarding a Village of Irvington resolution with regard to the recently enacted legislation for more timely disbursements of mortgage recording taxes was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.

THOMAS ABINANTI: Senior Citizen Program: Forwarding correspondence from Supervisor Feiner of the Town of Greenburgh with regard to an innovative senior citizen program was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Generational, Cultural and Ethnic Diversity.
COMMUNICATION: HON. GORDON BURROWS: Banning artificial trans-fats: Forwarding his memo to Legislation Chair Clinton I. Young, Jr. requesting his Committee consider legislation mandating the phase-out of the use of artificial trans-fats in Westchester’s food establishments was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Legislation and the Committee on Family, Health and Human Services.

COMMUNICATION: HON. THOMAS ABINANTI: Voting System: Forwarding a Resolution authorizing a lawsuit in connection with Westchester County’s voting system was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Legislation.
COMMUNICATION: NOTICE OF CLAIM: Providence Zumbo as Administratrix of the Estate of John D. Zumbo against Town/Village of Harrison, Village of Rye Brook, City of Rye and County of Westchester was on the motion of Mr. Rogowsky received, filed and referred to the County Attorney.
COMMITTEE ON BUDGET & APPROPRIATIONS: Public Hearing-Tax Exemptions for Senior Citizens: RES 187-2006: Setting a Public Hearing on a proposed Local Law enacting a new income scale for Chapter 470 of the Laws of Westchester County in order to provide real property tax exemptions to the greatest possible number of qualifying senior citizens. [Public Hearing set for October 23, 2006; at 7:30 p.m.; Local Law Intro. 16-2006]

COMMITTEE ON BUDGET & APPROPRIATIONS: Public Hearing-Tax Exemptions for Persons with Disabilities: RES 188-2006: Setting a Public Hearing on a proposed Local Law enacting a new income scale for Chapter 472 of the Laws of Westchester County in order to provide real property tax exemptions to the greatest possible number of qualifying disabled persons. [Public Hearing set for October 23, 2006; at 7:30 p.m.; Local Law Intro. 17-2006]

COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON HOUSING, PLANNING AND GOVERNMENT OPERATIONS: IMAs-GIS Services: ACT 202-2006: Act authorizing IMAs with the municipalities located in the County of Westchester, and with the counties of Putnam, Rockland, Dutchess, and the municipalities located within such counties, whereby the County would provide Geographic Information Systems services.

[Public Hearing set for October 23, 2006; at 7:30 p.m.; ACT. 203-2006]

COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: IMA-New Castle: ACT 205-2006: Act authorizing the County to enter into an IMA with the Town of New Castle pursuant to which the County will construct approximately 530 feet of sewer piping and five (5) manholes for (3) new connections so as to provide better access.
