COUNTY BOARD OF LEGISLATORS

The County Board of Legislators met pursuant to adjournment.
The Honorable William J. Ryan in the Chair.
The Chair opened the meeting with the salute to our flag and an invocation.
The roll call resulted as follows:

Mr. Rogowsky moved that the minutes of March 26, 2007 (Regular Meeting) be approved – Carried.
COMMUNICATION: COUNTY EXECUTIVE: Budget Transfers: Proposed Resolution transferring funds within the budgets for the various sewer districts in the total amount of $453,089 was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.
COMMUNICATION: COUNTY EXECUTIVE: Designation of Tourist Promotion Agency: Designating the Westchester County Office of Tourism as the “Tourist Promotion Agency” for Westchester County was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.
COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Proposed Act authorizing the County to issue bonds in the total amount of $1,950,000 to finance Capital Project B042A-Roof Replacement Program (2007-2011), Various Locations was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.
COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Proposed Act authorizing the County to issue bonds in the total amount of $1,380,000 to finance Capital Project P0019-Bronx River Parkway over Bronx River, (Northbound North of Harney Road) Yonkers and Eastchester was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.
COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Proposed Act authorizing the County to issue bonds in the total amount of $1,380,000 to finance Capital Project P0020-Bronx River Parkway over Bronx River, (Northbound South of Harney Road) Yonkers and Eastchester was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.
COMMUNICATION: COUNTY EXECUTIVE: IMA-Westchester County Civilian Applicant Processing System: Proposed Act authorizing the County to enter into IMAs with the municipalities located in the County of Westchester, the Counties of Putnam, Rockland, and Dutchess, and the municipalities located within such counties, whereby the County would provide the municipalities with access to a system called the Westchester County Civilian Applicant Processing System (CAPS) to allow for the electronic transmission and storage of civil application information was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety and Security.
COMMUNICATION: HON. WILLIAM RYAN: Legal Services of the Hudson Valley: Forwarding correspondence with regard to funding for Legal Services of the Hudson Valley under the request for Proposals for Eviction Prevention Funds was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Housing, Planning and Government Operations.
COMMUNICATION: HON. WILLIAM RYAN: Westchester Medical Center: Forwarding correspondence from the president and CEO of the Westchester Medical Center with regard to Joint Commission Accreditation was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Family, Health and Human Services.
COMMUNICATION: HON. WILLIAM RYAN: Lawn Fertilizer Regulations: Forwarding correspondence from the New York State Lawn Care Association with regard to a proposed Local Law to restrict use and sale of fertilizers containing component phosphorus was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Legislation and the Committee on the Environment and Energy.
COMMUNICATION: HON. WILLIAM RYAN: Lawn Fertilizer Regulations: Forwarding correspondence from the Scotts Miracle-Gro Company with regard to lawn fertilizer regulations was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Legislation and the Committee on the Environment and Energy.
COMMUNICATION: HON. BERNICE SPRECKMAN: Gasoline Tax Relief: Forwarding constituent correspondence with regard to gasoline tax relief was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.
COMMUNICATION: HON. JUDY MYERS: Davids Island: Forwarding a Fact Sheet with regard to the beginning of a Site Investigation at Davids Island was on the motion of Mr. Rogowsky received, filed and referred to the Committee on the Environment and Energy.
COMMUNICATION: CLERK OF THE BOARD: Designation of Deputies: Forwarding the Designation of Deputies for the Department of Community Mental Health was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Appointments.
COMMUNICATION: HON. GEORGE OROS: Sewer District Modification: Forwarding correspondence with regard to the reinstatement of parcels in the Town of Cortlandt into the Peekskill Sanitary Sewer District. (East Main Street, Skyview Avenue, Regina Avenue & Lexington Avenue) was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.
COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: Bond Act: (BOND) ACT 74-2007: Act authorizing the issuance of $330,000 in bonds to finance Capital Project B0077 – Infrastructure Improvements, Valhalla Campus.
Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

COMMITTEE ON BUDGET & APPROPRIATIONS: IMA-Mt. Pleasant: ACT 77-2007 (as amended): Act authorizing the County to enter into an IMA with the Town of Mt. Pleasant whereby the County will grant the Town a license to use an approximately five acre site located on the Grasslands Reservation for municipal recreation.
Mr. Kaplowitz made a motion, seconded by Ms. Swanson to replace the committee report and Act with the attached amended version, which motion was carried.
