COUNTY BOARD OF LEGISLATORS

JUNE 5, 2006 (7:00 P.M.)

The County Board of Legislators met pursuant to adjournment.

The Honorable William J. Ryan in the Chair.

The Chair opened the meeting with the salute to our flag and an invocation.

The roll call resulted as follows:

Motion – Approval of Minutes. Mr. Rogowsky moved that the minutes of May 22, 2006 (Regular Meeting) be approved – Carried.

PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS: Sewer District Consolidation: Local Law Intro. 9-2006: Proposed Local Law allowing for the consolidation of all operations and maintenance costs incurred in the County sanitary sewer system.

There were seven speakers.

No other person wishing to be heard, Mr. Rogowsky moved to close the Public Hearing and resume the regular order of business.

COMMUNICATION: COUNTY EXECUTIVE: IMAs – “Invest-in
Kids”: Proposed Act authorizing the County to enter into IMAs with
the cities of Mt. Vernon, Peekskill and White Plains for the provision
of services under the County’s Urban Youth Initiative “Invest-
in-Kids” Program was on the motion of Mr. Rogowsky received, filed

COMMUNICATION: COUNTY EXECUTIVE: IMA-Town of Cortlandt: Proposed Act authorizing an IMA with the Town of Cortlandt whereby the County would license approximately 161 acres of Oscawana/McAndrews Park to the Town to be used exclusively for municipal recreational purposes was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.

COMMUNICATION: COUNTY EXECUTIVE: Rabies Vaccines: Proposed Act authorizing the County to enter into an agreement with WCHCC, by and through the Department of Health, for the administration of rabies and booster rabies vaccines as needed for Department employees was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Family, Health and Human Services

COMMUNICATION: HON. WILLIAM RYAN: Hemlock Hill Farm: Forwarding a copy of a letter from the NYS Department of Agriculture and Markets requesting the County name an authorized representative to work with the State on the development of a contract for the purchase of easements or development rights for Hemlock Hill Farm was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Housing, Planning and Government Operations.

COMMUNICATION: HON. CLINTON YOUNG: Home Rule Request: Forwarding a Home Rule Request in support of A.9288/S.6361 entitled, “An Act to amend the vehicle and traffic law, in relation to the production of and the assessment of a surcharge for distinctive ‘Westchester Way’ license plates; and to amend the state finance law, in relation to establishing the New York State Westchester Way fund was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Legislation.

COMMITTEE ON ENVIRONMENT & ENERGY: Setting of Public Hearing-Agricultural District Additions: RES 107-2006: Setting a Public Hearing on a proposed Resolution for the inclusion of additional parcels of land within Westchester County Agricultural District No. 1 [Public Hearing set for June 19, 2006; at 7:30 p.m.; Resolution 108-2006].

Mr. Abinanti presented the following Resolution and moved its adoption, which was declared adopted.

COMMITTEE ON ENVIRONMENT & ENERGY AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: Lead Agency Status: RES 109-2006: Resolution declaring the Board of Legislators as lead agency for the environmental review for various projects and modification of the airport layout plan at the Westchester County Airport; adopting a Positive Declaration for the proposed action; and setting a date for a public scoping session.

Mr. Abinanti and Mr. Alvarado presented the Resolution and moved its adoption, which was declared adopted.

On the motion of Mr. Rogowsky, seconded by Ms. Stewart-Cousins, a motion was made to add the following resolution by unanimous consent: RES 110 2006: A resolution asking Homeland Security to restore funding to New York City by 40.1% which is the amount that was slashed from the budget.
