COUNTY BOARD OF LEGISLATORS

OCTOBER 23, 2006 (7:00 P.M.)

The County Board of Legislators met pursuant to adjournment.

The Honorable William J. Ryan in the Chair.

The Chair opened the meeting with the salute to our flag and an invocation.

The roll call resulted as follows:

Motion – Approval of Minutes. Mr. Rogowsky moved that the minutes of October 10, 2006 (Regular Meeting) be approved – Carried.

Mr. Rogowsky moved to suspend the regular order of business for the purpose of holding four public hearings. – Carried.

The Clerk presented proof of publication of notice of the Public Hearings and read the rules for its conduct.

PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS: Tax Exemptions for Senior Citizens: LOCAL LAW INTRO. 16-2006: Proposed Local Law enacting a new income scale for Chapter 470 of the Laws of Westchester County in order to provide real property tax exemptions to the greatest possible number of qualifying senior citizens.

There was one speaker.

No other person wishing to be heard, Mr. Rogowsky moved to close the Public Hearing and resume the regular order of business.

PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS: Tax Exemptions for Persons with Disabilities: LOCAL LAW INTRO. 17-2006: Proposed Local Law enacting a new income scale for Chapter 472 of the Laws of Westchester County in order to provide real property tax exemptions to the greatest possible number of qualifying disabled persons.

PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: Lease Agreement: LOCAL LAW INTRO 18-2006: Proposed Local Law to amend a lease agreement with Piedmont Hawthorne Aviation, L.L.C., for space at the Westchester County Airport.

PUBLIC HEARING: COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: Sewer District Modification: ACT 203-2006: Proposed Act to modify the Peekskill Sanitary Sewer District by the addition of one (1) parcel of property located in the Town of Cortlandt.

UNFINISHED BUSINESS: COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS, TRANSPORTATION, LABOR & PARKS: IMA-New Castle: ACT 205-2006: Act authorizing the County to enter into an IMA with the Town of New Castle pursuant to which the County will construct approximately 530 feet of sewer piping and five (5) manholes for (3) new connections so as to provide better access.

Anthony M. Landi, et al. and authorizing the County to pay Mirande and Sokoloff for legal services rendered in connection with the action was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: 2007 Proposed Capital Budget: Providing appropriations for the County 2007 Capital Budget was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: Petrillo Plaza-City of Mt. Vernon: Proposed packet of legislation including an Act authorizing the County to enter into an IMA with the City of Mt. Vernon to undertake improvements to Petrillo Plaza; an Act amending the County 2006 Capital Budget in relation to the project and a Bond Act Amendment to revise the scope, estimated maximum cost and plan of financing for the project was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works, Transportation, Labor and Parks.

COMMUNICATION: COUNTY EXECUTIVE: Septage Removal Reimbursement Program: Proposed Local Law amending the Laws of Westchester County to establish a program to reimburse owners of certain parcels for costs associated with routine septage removal and inspection services relative to separate sewage disposal systems was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations and the Committee on Legislation.
COMMUNICATION: COUNTY EXECUTIVE: Contract Amendment: Proposed Act authorizing the County to amend its contract with the law firm of Whiteman, Osterman & Hanna LLP in connection with the provision of legal representation to the County with respect to energy issues in order to increase the amount to be paid to the firm was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: Well-Water Systems Testing: Proposed Local Law to add a new Chapter 707 of the Laws of Westchester County to require the testing of private well-water systems upon the sale of property and for leased properties within the County of Westchester was on the motion of Mr. Rogowsky received, filed and referred to the Committee on Environment and Energy and the Committee on Legislation.

COMMITTEE ON BUDGET & APPROPRIATIONS: 2007 County Budget: RES 199-2006: Adopting certain rules for the conduct of the public hearing concerning the proposed 2007 County Budget.

COMMITTEE ON BUDGET & APPROPRIATIONS: 2007 County Budget: RES 200-2006: Suspending Rules 9 and 11 of the Board of Legislators solely and exclusively with regard to the 2007 proposed Westchester County Budget.

COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON PUBLIC SAFETY & SECURITY: IMA-Town of Cortlandt: ACT 218-2006: Act authorizing the County to enter into an IMA with the Town of Cortlandt whereby the County, acting through its Department of Public Safety Services, shall provide supplemental police services to the Town.
