COUNTY BOARD OF LEGISLATORS
SPECIAL MEETING


DECEMBER 21, 2004 (3:30 P.M.)

The County Board of Legislators met pursuant to adjournment.

The Honorable William J. Ryan in the Chair.

The Chair opened the meeting with the salute to our flag and an invocation.

The roll call resulted as follows:

Legislators: Young, Oros, Alvarado, Astorino, Bronz, Kaplowitz, Latimer, Maisano, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 14.

Absent: Abinanti, LaMotte, Mosiello - 3.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: IMA: Act authorizing the County to enter into IMAs with local municipalities to carry out the purposes set forth in NYS Mental Hygiene Law was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Health.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Inmate Health Care Services: Act authorizing the County to extend an agreement with WCHCC for comprehensive health care services to inmates at the County Jail was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety and Criminal Justice.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: HIV/AIDS Services: Act authorizing the County to amend an agreement with WCHCC whereby WCHCC shall purchase a new mobile medical van to provide primary care services to residents with HIV/AIDS was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee Health.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Appointment: Resolution confirming the appointment of Tejash V. Sanchala as a member of the County Human Rights Commission was on motion of Mr. Young received, filed and referred to the Committee on County Officers and Departments.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Appointment: Resolution confirming the appointment of Michael Whalen as a member of the County Electrical Licensing Board was on motion of Mr. Young received, filed and referred to the Committee on County Officers and Departments.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Appointment: Resolution confirming the appointment of Robert J. Buckley as a member of the County Deferred Compensation Board was on motion of Mr. Young received, filed and referred to the Committee on County Officers and Departments.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Barnhart Park: Local Law authorizing the County to enter into an IMA with the Village of Sleepy Hollow regarding Barnhart Park was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Parks.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the issuance of $1,250,000 in bonds to finance a recreational area at Barnhart Park in Sleepy Hollow (BLA01) was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Parks.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Ichabod’s Landing: Act authorizing the County to purchase an ownership interest in property known as “Ichabod’s Landing in Sleepy Hollow and to convey a conservation easement to NYS was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Parks.

SPECIAL ORDER: COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the issuance of $900,000 in bonds to finance the cost of acquisition of an undivided interest in Riverfront Land in Sleepy Hollow (BLA01) was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Parks.

SPECIAL ORDER: COMMUNICATION: HON. URSULA LAMOTTE: Bedford Center Road: Constituent correspondence regarding a potentially unsafe road condition in Bedford was on motion of Mr. Young received, filed and referred to the Committee on Public Works.

SPECIAL ORDER: NOTICES AND PETITIONS: HON. GEORGE OROS: Minority Committee Report: Petition for consideration of Minority Committee Report on proposed WCHCC Appointments was on motion of Mr. Young received, filed and referred to the Committee on County Officers and Departments.


SPECIAL ORDER: COMMITTEE ON BUDGET & APPROPRIATIONS: Pay Plan Amendment: ACT 238-2004 (AS AMENDED): Act amending personnel rules in Westchester County and authorizing modifications and continuance of benefits for those County employees designated as managerial and who are not part of any collective bargaining unit.

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

AYE: Legislators: Young, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 11.

NAY: Legislators: Oros, Astorino, Maisano – 3.
SPECIAL ORDER: COMMITTEE ON BUDGET & APPROPRIATIONS: Pay Plan Amendment: ACT 239-2004 (AS AMENDED): Act further amending personnel rules in Westchester County service and adopting classification of positions and schedules of pay.

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

AYE: Legislators: Young, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 11.

NAY: Legislators: Oros, Astorino, Maisano – 3.
SPECIAL ORDER: COMMITTEE ON COUNTY OFFICERS & DEPARTMENTS: WCHCC Governing Board Appointment: ACT 241-2004: Act appointing Dennis Mehiel to serve on the Governing Board of the Westchester County Health Care Corporation.

The motion made by Mr. Pinto, seconded by Mrs. Bronz, to take from the table ACT 241-2004 regarding the appointment of Dennis Mehiel to serve on the Governing Board of the Westchester County Health Care Corporation, was carried by the following vote:

AYE: Legislators: Young, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 11.

NAY: Legislators: Oros, Astorino, Maisano – 3.

Mr. Pinto presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

AYE: Legislators: Young, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 11.

NAY: Legislators: Oros, Astorino, Maisano – 3.


SPECIAL ORDER: COMMITTEE ON COUNTY OFFICERS & DEPARTMENTS: WCHCC Governing Board Reappointment: ACT 243-2004: Act reappointing Jon Halpern to serve on the Governing Board of the Westchester County Health Care Corporation.

The motion made by Mr. Pinto, seconded by Wishnie, to take from the table ACT 243-2004 regarding the reappointment of Jon Halpern to serve on the Governing Board of the Westchester County Health Care Corporation, was carried by the following vote:

AYE: Legislators: Young, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Chair – 10.

NAY: Legislators: Oros, Astorino, Maisano, Spreckman – 4.

Mr. Pinto presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

AYE: Legislators: Young, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Chair – 10.

NAY: Legislators: Oros, Astorino, Maisano Spreckman– 4.


SPECIAL ORDER: COMMITTEE ON COUNTY OFFICERS & DEPARTMENTS: WCHCC Governing Board Appointment: ACT 244-2004: Act appointing Herman Geist to serve on the Governing Board of the Westchester County Health Care Corporation.

The motion made by Mr. Pinto, seconded by Mrs. Stewart-Cousins, to take from the table ACT 244-2004 regarding the appointment of Herman Geist to serve on the Governing Board of the Westchester County Health Care Corporation, was carried by the following vote:

AYE: Legislators: Young, Alvarado, Astorino, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Chair – 11.

NAY: Legislators: Oros, Maisano Spreckman– 3.
