COUNTY BOARD OF LEGISLATORS


NOVEMBER 8, 2004 (7:00 P.M.)

The County Board of Legislators met pursuant to adjournment.

The Honorable William J. Ryan in the Chair.

The Chair opened the meeting with the salute to our flag and an invocation.

The roll call resulted as follows:

Absent: Mosiello -1.

Motion – Approval of Minutes. Mr. Young moved that the minutes of October 25, 2004 (Regular Meeting) be approved – Carried.

Mr. Young moved to suspend the regular order of business for the purpose of holding a public hearing – Carried.

The Clerk presented proof of publication of notice of the Public Hearing and read the rules for its conduct.

PUBLIC HEARING: COMMITTEES ON BUDGET AND APPROPRIATIONS & PARKS AND RECREATION: Tibbetts Brook Park: LOCAL LAW INTRO 19-2004: Local Law authorizing the County to enter into a lease agreement with New York State whereby the County will lease property next to Tibbetts Brook Park in Yonkers in order to construct athletic fields.

There were no speakers.

No other person wishing to be heard, Mr. Young moved to close the Public Hearing and resume the regular order of business.

COMMUNICATION: COUNTY EXECUTIVE: Capital Budget Amendment: Act amending the County 2004 Capital Budget was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the issuance of $3,400,000 in bonds to finance the cost of partial reconstruction of the County-owned Mount Vernon office building (BGS03) was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: Property Lease: Local Law authorizing the County to enter into a sublease with WCHCC for space at Cedarwood Hall, and to then sublease the space to WIHD was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Health.

COMMUNICATION: COUNTY EXECUTIVE: Physical and Sexual Abuse Assessments: Act authorizing the County to enter into an agreement with WCHCC whereby WCHCC shall provide physical and sexual assessments of children alleged to be victims of abuse was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety and Criminal Justice.

COMMUNICATION: COUNTY EXECUTIVE: Transfer Resolution: Transfer resolution for transfer of funds in the 2004 DPW Budget was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works.

COMMUNICATION: COUNTY EXECUTIVE: IMA: Act authorizing the County to enter into IMAs to house inmates from municipalities outside the County and vice versa was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety and Criminal Justice.

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the County to issue a total of $7,800,000 in bonds for the Bronx River Parkway Repaving Program (P0004) and a related capital budget amendment was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works.

COMMUNICATION: COUNTY EXECUTIVE: Property Conveyance: Act authorizing the County to convey property to Steven Waugh was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: Westchester County Agricultural District: Resolution recommending the inclusion of additional parcels of land within the County Agricultural District was on motion of Mr. Young received, filed and referred to the Committee on Environment.

COMMUNICATION: HON. TOM ABINANT: Accessible Units in Affordable Housing: Correspondence from the County Executive regarding adoption of a County policy for the provision of housing units for people with disabilities was on motion of Mr. Young received, filed and referred to the Committee on Housing and the Committee on Community Affairs.

COMMUNICATION: HON. GEORGE LATIMER: Apprenticeship Agreements Law: Resubmitting proposed legislation regarding apprenticeship agreements for County contracts was on motion of Mr. Young received, filed and referred to the Committee on Labor.

COMMUNICATION: HON. GEORGE LATIMER: Flu Vaccine: Correspondence from Dr. Lipsman regarding scheduled flu clinics was on motion of Mr. Young received, filed and referred to the Committee on Health and the Committee on Community Affairs.

COMMUNICATION: HON. BILL RYAN: Police Disciplinary Procedures: Proposal for amendment of disciplinary procedures for village and town police in Westchester was on motion of Mr. Young received, filed and referred to the Committee on Public Safety and Criminal Justice.

COMMUNICATION: HON. LOIS BRONZ: Sewage Diversion: Constituent correspondence expressing concerns about the sewage diversion plan was on motion of Mr. Young received, filed and referred to the Committee on Environment, the Committee on Health, the Committee on Budget and Appropriations, the Committee on Public Works, and the Committee on Cultural and Ethnic Diversity.

COMMUNICATION: HON. LOIS BRONZ: Sewage Diversion: Community op ed piece supporting the sewage diversion plan was on motion of Mr. Young received, filed and referred to the Committee on Environment, the Committee on Health, the Committee on Budget and Appropriations, the Committee on Public Works, and the Committee on Cultural and Ethnic Diversity.

COMMUNICATION: HON. MICHAEL KAPLOWITZ: Playland Boathouse: Correspondence from the Historic Preservation Advisory Committee in support of Playland Boathouse rehabilitation was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Parks.

COMMUNICATION: HON. MICHAEL KAPLOWITZ: 2-1-1 Service: Information from Family Information and Referral Service Teams, Inc. regarding 2-1-1 services for health and human services information was on motion of Mr. Young received, filed and referred to the Committee on Community Affairs, the Committee on Health and the Committee on Budget and Appropriations.

COMMITTEES ON BUDGET AND APPROPRIATIONS & PARKS AND RECREATION: Tibbetts Brook Park - Environmental: RES 200-2004: LOCAL LAW Resolution finding no significant impact on the environment with respect to an agreement with New York State whereby the County will lease property next to Tibbetts Brook Park in Yonkers in order to construct athletic fields.

Mr. Kaplowitz presented the following Resolution and Moved its adoption, which was declared adopted.

COMMITTEE ON BUDGET AND APPROPRIATIONS & LEGISLATION: Itemization of Costs in the County Tax Bill: RES 199-2004: Setting a Public Hearing on a proposed Local Law allowing the County to itemize costs contained in the County’s Tax Bill. [Public Hearing set for __________, 2004; at _____.m; Local Law Intro 20-2004.]

The following item was laid “OVER” under the rules by Mr. Oros.

COMMITTEES ON BUDGET AND APPROPRIATIONS AND PARKS: Capital Budget Amendment – Hilltop Hanover Renovations: ACT 181-2004: Act amending the 2004 Capital Budget regarding Hilltop Hanover renovations.

The motion made by Mr. Kaplowitz, seconded by Mr. Wishnie to remove Act 181-2004 from the Table was carried by the following vote:

COMMITTEES ON BUDGET AND APPROPRIATIONS AND PARKS: Bond Act – Hilltop Hanover Renovations: (BOND) ACT 180-2004: Bond Act authorizing the issuance of $900,000 in bonds to finance the cost of partial reconstruction of facilities at the Hilltop Hanover Conservation and Resource Center (B0080).

The motion made by Mr. Kaplowitz, seconded by Mr. Wishnie to remove Act 180-2004 from the Table was carried by the following vote:
