COUNTY BOARD OF LEGISLATORS


OCTOBER 12, 2004 (7:00 P.M.)

The County Board of Legislators met pursuant to adjournment.

The Honorable William J. Ryan in the Chair.

The Chair opened the meeting with the salute to our flag and an invocation.

The roll call resulted as follows:

Absent: None.

Motion – Approval of Minutes. Mr. Young moved that the minutes of September 27, 2004 (Regular Meeting) be approved – Carried.

UNFINISHED BUSINESS: Affordable Housing Plan: COMMUNICATION: HON. LOIS BRONZ: Memorandum from the County Executive regarding an Action Plan to respond to the new Affordable Housing Needs Assessment was on motion of Mr. Young received, filed and referred to the Committee on Housing, Committee on Budget & Appropriations, Committee on Environment, Committee on Legislation, and Committee on Community Affairs.

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the issuance of $250,000 in bonds to finance Mohansic Golf Course Rehabilitation (RCG05) was on motion of Mr. Young received, filed and referred to the Committee on Budget & Appropriations and Committee on Parks.

COMMUNICATION: COUNTY EXECUTIVE: Intermunicipal Agreement: Act authorizing the County to enter into an IMA with the Town of Cortlandt for the maintenance of parkland for municipal recreation purposes was on motion of Mr. Young received, filed and referred to the Committee on Budget & Appropriations and Committee on Parks.

COMMUNICATION: COUNTY EXECUTIVE: IMA: Act authorizing the County to enter into an IMA with the Town of Mount Pleasant whereby the Town will maintain an athletic field to be constructed by the County was on motion of Mr. Young received, filed and referred to the Committee on Budget & Appropriations and Committee on Parks.

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the issuance of $1,400,000 to finance the cost of construction of an athletic field in the Town of Mount Pleasant was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and Committee on Parks.

COMMUNICATION: COUNTY EXECUTIVE: IMA: Act amending an IMA with the City of New Rochelle for prisoner transportation services was on motion of Mr. Young received, filed and referred to the Committee on Budget & Appropriations Committee on Public Safety & Criminal Justice.

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the issuance of bonds in the amount of $175,000 to finance the purchase of a heavy truck lift (A066A) was on motion of Mr. Young received, filed and referred to the Committee on Budget & Appropriations and Committee on Public Works.

COMMUNICATION: COUNTY EXECUTIVE: IMA: Act amending an IMA with the City of Peekskill for prisoner transportation services was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and Committee on Public Safety and Criminal Justice.

COMMUNICATION: CITIZEN COMMUNICATION: Board Meeting Proceedings: Constituent correspondence regarding conduct of the September 14 BOL meeting was on motion of Mr. Young received, filed and referred to the Committee on Rules.

COMMUNICATION: HON. MARTIN ROGOWSKY: Secondhand Smoke: New article on the dangers of secondhand cigarette smoke was on motion of Mr. Young received, filed and referred to the Committee on Legislation and the Committee on Health.

COMMUNICATION: HON. MICHAEL KAPLOWITZ: Gasoline Pricing: Constituent correspondence regarding “zone pricing” of gas in Westchester County was on motion of Mr. Young received, filed and referred to the Committee on Community Affairs and the Committee on Energy.

COMMUNICATION: HON. MICHAEL KAPLOWITZ: Early Intervention: Correspondence from Assemblywoman Amy Paulin regarding reform of the Early Intervention Program was on motion of Mr. Young received, filed and referred to the Committee on Legislation and the Committee on Families.

COMMUNICATION: HON. WILLIAM RYAN: Fatality Report: Child fatality report from the NYS Office of Children and Family Services was on motion of Mr. Young received, filed and referred to the Committee on Public Safety & Criminal Justice and the Committee on Families.

COMMUNICATION: HON. WILLIAM RYAN: East of Hudson Funds: Resolution from the Town of North Salem recommending the allocation of East of Hudson Funds for the implementation of water quality improvement projects was on motion of Mr. Young received, filed and referred to the Committee on Environment and the Committee on Budget & Appropriations.

COMMUNICATION: HON. WILLIAM RYAN: Recording Fee: Request from the County Clerk for an additional recording fee to help offset the cost of computer updates and maintenance of computer technologies was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: HON. TOM ABINANTI: Family Courts: 1997 letter from the Office of Court Administration regarding the New Rochelle and Yonkers Family Courts was on motion of Mr. Young received, filed and referred to the Committee on Families, Committee on Public Safety and Criminal Justice and the Committee on Intergovernmental Relations.

COMMUNICATION: HON. MICHAEL KAPLOWITZ: Sewage Diversion: Correspondence from the NYC Department of Environmental Protection to the North Salem Supervisor regarding the proposal to divert wastewater facilities out of the Croton watershed was on motion of Mr. Young received, filed and referred to the Committee on Budget & Appropriations, Committee on Public Works, Committee on Environment, Committee on Health and the Committee on Cultural and Ethnic Diversity.

COMMUNICATION: HON. TOM ABINANTI: Affordable Housing: Memorandum from Legislator Abinanti to CA requesting the County’s files in the Livingston manor affordable housing project was on motion of Mr. Young received, filed and referred to the Committee on Housing.

COMMUNICATION: HON. TOM ABINANTI: Request for Public Hearing-Highway Rail Crossings: Requesting a public hearing regarding new technology to improve traffic control for highway-rail grade crossings was on motion of Mr. Young received, filed and referred to the Committee on Transportation and the Committee on Technology.

COMMUNICATION: CLERK OF THE BOARD: Prescription Drug Importation: Resolution from the Cattaraugus County Legislature supporting federal legislation authorizing the importation of prescription drugs from foreign countries was on motion of Mr. Young received, filed and referred to the Committee on Legislation and the Committee on Health.

COMMITTEE ON BUDGET AND APPROPRIATIONS: Payment of Fees and Charges via Internet: ACT 190-2004: Act authorizing the Commissioner of Finance to accept the payment of fines, penalties, charges, etc. (but excluding taxes) owed to the County via a municipal Internet website.

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

AYE: Legislators: Young, Oros, Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Maisano, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 15.

NAY: None.

Messrs. Latimer and Mosiello were not present when the vote was taken.
COMMITTEES ON BUDGET AND APPROPRIATIONS & TRANSPORTATION: Amendment to Retainer Agreement: ACT 191-2004: Act amending a retainer agreement with the law firm of Kaplan Kirsch & Rockwell regarding the Terminal Capacity Agreement at the County Airport.

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

AYE: Legislators: Young, Abinanti, Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Wishnie, Chair – 10.

NAY: Legislators: Oros, Astorino, LaMotte, Maisano, Spreckman – 5.

Legislators Mosiello and Stewart-cousins were not present when the vote was taken.
COMMITTEES ON BUDGET AND APPROPRIATIONS & HEALTH & PUBLIC SAFETY:
Regional Emergency Medical Services Mutual Aid Agreement: RES 186-2004: Setting a Public Hearing on a proposed Local Law authorizing the County to enter into an agreement with New York City and Suffolk and Nassau Counties for participation in the Regional Medical Services Mutual Aid Agreement. [Public Hearing set for October 25, 2004; at 7:30 p.m.; Local Law Intro 18-2004.]

Mr. Kaplowitz presented the following Resolution and moved its adoption, which was declared adopted by the following vote:

AYE: Legislators: Young, Oros, Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Pinto, Rogowsky, Spreckman, Wishnie, Chair – 15.

NAY: None.

COMMITTEE ON LEGISLATION: For-Hire Vehicle Law: LOCAL LAW INTRO 13-2004: Local Law amending the definition of a taxicab as set forth in the County For-Hire Vehicle Law.

Mr. Rogowsky presented the following item which was laid “OVER” under the rules by Mr. Astorino.

COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS: Board of Health Appointment: RES 187-2004: Confirming the appointment of Nancy Seligson as a member of the County Board of Health.

Mr. Pinto presented the following Resolution and moved its adoption, which was declared adopted by the following vote:

AYE: Legislators: Young, Oros, Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Pinto, Rogowsky, Spreckman, Wishnie, Chair – 15.

NAY: None.

COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS: African American Advisory Board Reappointment: RES 188-2004: Confirming the reappointment of Albert Wesley as a member of the County African American Advisory Board.

Mr. Pinto presented the following Resolution and moved its adoption, which was declared adopted by the following vote:

AYE: Legislators: Young, Oros, Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Pinto, Rogowsky, Spreckman, Wishnie, Chair – 15.

NAY: None.

COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS: Women’s Advisory Board Appointment: RES 189-2004: Confirming the appointment of Mildred Roldan-Matin, Ph.D. as a member of the County Women’s Advisory Board.

Mr. Pinto presented the following Resolution and moved its adoption, which was declared adopted by the following vote:

AYE: Legislators: Young, Oros, Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 16.

COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS: Council for Seniors Appointment: RES 190-2004: Confirming the appointment of Marilyn Keosayian as a member of the County Council for Seniors.

Mr. Pinto presented the following Resolution and moved its adoption, which was declared adopted by the following vote:

AYE: Legislators: Young, Oros, Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Pinto, Rogowsky, Spreckman, Stewart-Cousins, Wishnie, Chair – 16.
