COUNTY BOARD OF LEGISLATORS

MARCH 15, 2004 (4:00 P.M.)

 

The CountyBoard of Legislators met pursuant to adjournment.

 

The Honorable William J. Ryan in the Chair.

 

The Chair opened the meeting with the salute to our flag and an invocation.

 

The roll call resulted as follows:

 

Legislators: Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Mosiello, Oros, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair – 16.

 

Absent: Spreckman - 1.

 

SPECIAL ORDER: CHAIR OF THE BOARD AND THE COMMITTEE ON LEGISLATION: 2004 State Legislative Package: RES 28-2004: Resolution approving a package of draft and proposed state legislation which could benefit Westchester County, and urging their passage by the New York State Legislature.

 

Mr. Rogowsky presented the above-captioned Resolution which was amended as follows:

 

On motion of Mrs. Stewart-Cousins, Item I, 2: “Authorize Law Enforcement Agencies to Impound Vehicles of Persons Arrested for DWI” was severed.

 

On motion of Mr. Rogowsky, the following item was recommitted.

 

On motion of Mrs. Stewart-Cousins, Item III, 1: “Give Security Personnel at Nuclear Power Plants certain Powers Associated with Peace Officers” was severed.

 

On motion of Mr. Rogowsky, the following item was recommitted.

 

On motion of Mrs. Stewart-Cousins, Item III, 2: “Permit Westchester to set its own Pistol Permit Fee” was severed.

 

On motion of Mr. Rogowsky, the following item was recommitted.

 

On motion of Mr. Alvarado, Item IV, 3: “Authorize Counties to charge Probation Fees” was severed.

 

On motion of Mr. Rogowsky, the following item was recommitted.

 

On motion of Mr. Oros, Item I, 1: “Increase Penalties for Counterfeiting, Misbranding, or Adulteration of Drugs” was severed.

 

On motion of Mr. Rogowsky the above captioned item was presented for inclusion back into the package, which motion was carried by the following vote:

 

AYE: Legislators: Alvarado, Bronz, Kaplowitz, Latimer, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair – 10.

 

NAY: Legislators: Oros, Astorino, LaMotte, Maisano – 4.

 

Note: Messrs. Abinanti and Mosiello were out for the vote.

 

On motion of Mr. Oros, Item II, 1: “Exempt Playland from Certain Provisions of the General Municipal Law” was severed.

 

On motion of Mr. Rogowsky, the following item was recommitted.

 

On motion of Mr. Oros, Item II, 3: “Reform Medicaid” was severed.

 

On motion of Mr. Rogowsky the above captioned item was presented for inclusion back into the package, which motion was carried by the following vote:

 

AYE: Legislators: Abinanti, Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Oros, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair – 15.

 

Mr. Mosiello was out for the vote.

 

On motion of Mr. Oros, the following Item: Legislative Initiative 1: “Prevent Identity Theft by Requiring Businesses to Disclose Security Breaches of Computerized Data” was severed.

 

On motion of Mr. Rogowsky the above captioned item was presented for inclusion back into the package, which motion was carried by the following vote:

 

AYE: Legislators: Astorino, Bronz, Kaplowitz, Latimer, Maisano, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair - 11.

 

NAY: Legislators: Oros, Alvarado, LaMotte – 3.

 

Messrs. Abinanti and Mosiello were out for the vote.

 

On motion of Mr. Oros, the following Item: Legislative Initiative 2: “Increase Penalties for Impersonating a Police Officer” was severed.

 

On motion of Mr. Rogowsky the above captioned item was presented for inclusion back into the package, which motion was carried by the following vote:

 

AYE: Legislators: Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Oros, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair - 14.

 

NAY: None.

 

Messrs. Abinanti and Mosiello were out for the vote.

 

On motion of Mr. Oros, the following Item: Legislative Initiative 6: “Expand Penalties for Making False Statements to a Police Officer” was severed.

 

On motion of Mr. Rogowsky the above captioned item was presented for inclusion back into the package, which motion was carried by the following vote:

 

AYE: Legislators: Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Oros, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair - 14.

 

NAY: None.

 

Messrs. Abinanti and Mosiello were out for the vote.

 

Mr. Rogowsky presented the 2004 State Legislative Package - Res 28-2004 (AS AMENDED) and moved its adoption, which was declared adopted by the following vote:

 

AYE: Legislators: Alvarado, Astorino, Bronz, Kaplowitz, LaMotte, Latimer, Maisano, Mosiello, Oros, Pinto, Rogowsky, Stewart-Cousins, Wishnie, Young, - Chair – 15.

 

NAY: None.
