COUNTY BOARD OF LEGISLATORS

JANUARY 26, 2004 (7:00 P.M.)

 

The CountyBoard of Legislators met pursuant to adjournment.

 

The Honorable William J. Ryan in the Chair.

 

The Chair opened the meeting with the salute to our flag and an invocation.

 

The roll call resulted as follows:

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the County to issue up to $1,800,000 in bonds to finance infrastructure improvements to shelter facilities at the Coachman Family Center (BSS10) was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations, the Committee on Housing and the Committee on Community Affairs.

 

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the County to issue up to $120,000 in bonds to finance the acquisition of an undercover surveillance van (BPS11) was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety and Criminal Justice.

 

COMMUNICATION: COUNTY EXECUTIVE: Compromise of Claim: Act authorizing the County Attorney to compromise the County’s right to be reimbursed for health care and wage benefits paid to a corrections officer was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations.

COMMUNICATION: COUNTY EXECUTIVE: Amendment to Solid Waste and Recyclables Collection Licensing Law: Local Law amending various provisions of the County Solid Waste and Recyclables Collection Licensing Law was on motion of Mr. Young received, filed and referred to the Committee on Legislation and the Committee on Environment.

 

COMMUNICATION: COUNTY EXECUTIVE: Bond Act: Bond Act authorizing the County to issue up to $250,000 in bonds to finance the Mamaroneck Sewer District pump station wide monitoring alarms (SM015) was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Works.

 

COMMUNICATION: COUNTY EXECUTIVE: Patient Referral to WCHCC: Act authorizing the County to enter into an agreement with WCHCC whereby the County will refer patients for tuberculosis-related services was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Health.

 

COMMUNICATION: COUNTY EXECUTIVE: Patient Referral to WCHCC: Act authorizing the County to enter into an agreement with WCHCC whereby the County will refer late syphilis patients for diagnosis services was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Health.

 

COMMUNICATION: COUNTY EXECUTIVE: Patient Referral to WCHCC: Act authorizing the County to enter into an agreement with WCHCC whereby the County will refer Department of Health patients in need of emergency medical services was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations and the Committee on Health.

 

COMMUNICATION: COUNTY EXECUTIVE: Health Services for Department of Correction Inmates: Act authorizing the County to enter into an agreement with WCHCC for comprehensive health services for inmates of the County Department of Correction was on motion of Mr. Young received, filed and referred to the Committee on Budget and Appropriations, the Committee on Health and the Committee on Public Safety and Criminal Justice.

 

COMMUNICATION: COUNTY EXECUTIVE: Westchester Community College Master Plan: Resolution adopting the draft Generic EIS for the Westchester Community College’s Campus Facilities Master Plan 1999 and Five Year Capital Program was on motion of Mr. Young received, filed and referred to the Committee on Education, the Committee on Budget and Appropriations, The Committee on Public Works and the Committee on Community Affairs.

 

COMMUNICATION: COUNTYEXECUTIVE: Bond Act: Bond Act authorizing the County to issue up to $850,000 in bonds to finance the cost of infrastructure improvements related to the Sprain Estates Affordable Housing Development Project was laid “over” under the Rules by Mr. Abinanti.

 

COMMUNICATION: COUNTYEXECUTIVE: Sprain Estates Affordable Housing Development Project: Act authorizing the County to enter into an intermunicipal agreement with the City of Yonkers and other parties regarding the purchase of land and further construction of the Sprain Estates Affordable Housing Development Project was laid “over” under the Rules by Mr. Abinanti.

Mr. Kaplowitz presented the following Resolution and moved its adoption, which was declared adopted.

 

COMMITTEEON BUDGET AND APPROPRIATIONS: Civil Service Examination Fees: ACT 2-2004: Act amending the schedule of application fees for a position in the competitive or non-competitive class of the civil service.

 

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

COMMITTEEON BUDGET AND APPROPRIATIONS: Colorectal Cancer Screening: ACT 3-2004: Act authorizing the County to enter into an agreement with WCHCC whereby WCHCC shall provide cancer screening services for County residents.

 

Mr. Kaplowitz presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

COMMITTEEON BUDGET AND APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS: Sewer District Modification: RES 4-2004: Setting a Public Hearing on a proposed Act modifying the Peekskill Sanitary Sewer District by the addition of 62 parcels located in the Town of Cortlandt. [Public Hearing set for February 9, 2004; at 7:30 p.m; Act 4-2004.]

 

Mr. Kaplowitz presented the following Resolution and moved its adoption, which was declared adopted.

 

COMMITTEEON BUDGET AND APPROPRIATIONS AND THE COMMITTEE ON PUBLIC WORKS: Amendment to Lease Agreement: RES 5-2004: Setting a Public Hearing on a proposed Local Law amending a lease agreement with Interlaken Capital Aviation for County property at the CountyAirport [Public Hearing set for February 9, 2004; at 7:30 p.m.; Local Law 1-2004.]

 

Mr. Kaplowitz presented the following Resolution and moved its adoption, which was declared adopted.

 

COMMITTEE ON RULES: Rules of the CountyBoard of Legislators: RES 6-2004: Resolution adopting various changes to the Rules of the CountyBoard of Legislators.

COMMITTEEON RULES: Amendment- Rule Six of the CountyBoard of Legislators: RES 7-2004: Resolution delegating to the Chairman of the Board of Legislators the power to appoint Board employees other than the Clerk of the Board, and the related power to perform administrative duties related to Board personnel for the 2004-2005 term.
